These Terms of Conditions (“Terms”) govern your use of Insert Affiliate, this website (“Website”), our deep linking attribution service at insertaffiliate.link, and any related services provided by Insert Affiliate Ltd. “Services” means the products and services that are made available by Insert Affiliate under these Terms, including but not limited to our deep linking and affiliate attribution technology. The Services do not cover (i) the functionality of web-based, mobile, offline, or other software applications that interact with a Service, which are supplied by you or a third party, and (ii) Third-Party Content, meaning any content, data, software, or services provided by a third party that you access or use in connection with the Services.

By accessing or using the Services, or by authorising any agent or end user of your Digital Properties (meaning the websites, mobile applications, and other digital channels you own or control and operate using the Services) to access or use the Services, you agree to be legally bound by all terms, conditions, and notices in this Agreement. If you do not agree with these Terms of Service, you are prohibited from further accessing our website or using any other services provided by Insert Affiliate.

If you are entering into this Agreement on behalf of a company, organization, or any other legal entity (referred to as an “Entity”), you are confirming your agreement to this Agreement on behalf of that Entity. You are representing that you have the authority to legally bind the Entity and its Affiliates to the Terms.

Account Registration and Eligibility

To use the Services you must register for an account and provide information that is accurate, current, and complete, and keep that information up to date. You are responsible for all activity that occurs under your account and for keeping your account credentials secure. You must be at least 18 years old and capable of forming a legally binding contract, and you must not use the Services where you are prohibited from doing so under any applicable law. We may refuse registration, or suspend or close an account, at our discretion where these Terms are breached or where we reasonably consider it necessary to protect the Services or other users.

Licence and Intellectual Property

The Services, the Website, our SDKs, APIs, documentation, and all related software, technology, designs, text, graphics, logos, and trademarks are owned by Insert Affiliate Ltd or its licensors and are protected by intellectual property and other laws. Subject to your continued compliance with these Terms, Insert Affiliate Ltd grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Services solely for operating your own Digital Properties for the duration of your subscription. No rights are granted to you other than as expressly set out in these Terms, and all rights not expressly granted are reserved by Insert Affiliate Ltd. You acquire no ownership interest in the Services, or any part of them, through your use of them.

Feedback and Testimonials

If you provide us with any feedback, suggestions, or ideas relating to the Services, you grant Insert Affiliate Ltd a perpetual, irrevocable, worldwide, royalty-free licence to use, incorporate, and exploit that feedback in our products and services without any obligation or payment to you. You also agree that we may identify you as a customer and use your name and logo to refer to you as a user of the Services in our marketing materials, subject to any reasonable restrictions you notify to us in writing, and we will cease such use on your written request.

Limitations of Use

By using Insert Affiliate and our website, you warrant on behalf of yourself, any entity who you represent who has entered into these Terms of Service, and your users that you will not:

• modify, copy, prepare derivative works of, decompile, or reverse engineer Insert Affiliate or any materials and software contained within Insert Affiliate or on our website;

• knowingly or negligently use Insert Affiliate or any of its associated services in a way that abuses or disrupts our networks or any other service Insert Affiliate Ltd provides;
• use Insert Affiliate or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
• use Insert Affiliate or its associated services in violation of any applicable laws or regulations;
• use Insert Affiliate to send unauthorised advertising or spam;
• extend, sell, distribute rent, lease, sublicense, or otherwise provide access to Insert Affiliate or its associated services to another person;
• harvest, collect, or gather user data without the user’s consent; or
• use Insert Affiliate or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Competitive Use Restrictions

Access to the Services is not permitted for the purpose of building, improving, or supporting a competing offering. Unless we have given you our prior written permission, you may not access or use the Services, the Website, our SDKs, APIs, or documentation where you are, or are acting for, a business that provides (or is preparing to provide) affiliate attribution, deep linking, mobile measurement, subscription analytics, or any other service that competes with Insert Affiliate. Regardless of who you are, you agree that you and anyone acting on your behalf will not:

• use the Services to track their uptime, performance, or feature set, or for any kind of benchmarking or competitive evaluation;
• reproduce, imitate, or take inspiration from the layout, workflow, dashboards, reporting, or overall look and feel of the Services in a rival product;
• share, publish, or otherwise make available any benchmark, performance, or comparison findings about the Services without first obtaining our written consent.

Use of Data, APIs and Outputs

All information, analytics, reporting, and other outputs that you obtain through the Services or our APIs — including affiliate, attribution, and performance data presented on dashboards — are provided to you only so that you can operate your own Digital Properties. You agree that you and anyone acting on your behalf will not:

• use that information or any output to design, develop, train, operate, or market any product, dataset, model, or service that competes with Insert Affiliate;
• aggregate, resell, relicense, or otherwise redistribute that information or any output to a third party;
• carry out automated scraping, harvesting, or bulk retrieval of data, or otherwise access the APIs beyond their documented purpose or any rate limits we set;
• attempt to bypass, disable, or interfere with any technical limit, authentication, or usage restriction applied to the Services or APIs.

We may monitor use of the APIs and may suspend or restrict access where we reasonably believe these restrictions have been breached.

API and Acceptable Use

Where we make APIs available, you must use them only in accordance with our documentation and any credentials we issue to you. You are responsible for keeping your API keys and credentials confidential and for all activity carried out through them. You must not exceed any rate limits or usage quotas that we publish, place an unreasonable or disproportionate load on our infrastructure, or use the APIs in any manner that could damage, disable, overburden, or impair the Services. We may set, change, or remove rate limits, quotas, and API features, and may deprecate or discontinue any API endpoint, at our discretion. Where reasonably practicable we will give notice of material changes, but we may act without notice where we consider it necessary to protect the security, integrity, or availability of the Services.

Deep Linking Attribution Service

Our deep linking attribution service at insertaffiliate.link provides affiliate tracking and attribution for mobile apps and websites. By using this service, you acknowledge and agree to the following:

• We collect device fingerprinting data, IP addresses, and other technical information to enable attribution matching between web clicks and app events
• Attribution data may be retained as necessary for commission calculation and fraud prevention purposes
• We use probabilistic attribution models that may not be 100% accurate in all cases
• You are responsible for ensuring your use of our attribution service complies with applicable privacy laws and regulations
• We reserve the right to terminate attribution services for accounts engaged in fraudulent or suspicious activity
• Attribution results are provided on a best-effort basis and may be affected by user privacy settings, ad blockers, or technical limitations

Liability

Insert Affiliate or its associated services and on our website are provided on an 'as is' basis. To the extent permitted by law, Insert Affiliate Ltd makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall Insert Affiliate Ltd or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use Insert Affiliate Ltd, our website, or any other services provided by Insert Affiliate Ltd or the materials in Insert Affiliate or its associated services, or an authorised representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

Because some jurisdictions do not allow limitations on implied warranties or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

In no event shall Insert Affiliate Ltds total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing or using Insert Affiliate Ltd’s services during the 6 months prior to the event giving rise to liability.

This limitation of liability applies to the fullest extent permitted by law and shall survive any termination or expiration of this agreement. Insert Affiliate Ltd shall not be liable for any failure or delay in the performance of its obligations under this agreement if such failure or delay results from circumstances beyond its reasonable control (including, but not limited to, acts of God, war, terrorism, pandemic, government restrictions, strikes, and natural disasters).

Accuracy of Materials

The materials appearing in Insert Affiliate or its associated services, or on our website are not comprehensive and are for general information purposes only. To the extent permitted by law, Insert Affiliate Ltd does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials in Insert Affiliate or its associated services or on our website, or otherwise relating to such materials or on any resources linked to Insert Affiliate or its associated services and our website.

User Confidentiality

Insert Affiliate values the confidentiality and security of user information. Users are responsible for maintaining the confidentiality of their account credentials and any personal data shared or accessed through the platform. Beta and Early Access Features

Beta Features are provided on an as-is basis for evaluation purposes, may contain errors or defects, and may be changed, suspended, or withdrawn by us at any time, without notice and without liability. We make no warranties of any kind in relation to Beta Features, they are not covered by any service level commitment, and you use them at your own risk. We may also impose additional terms on the use of any Beta Feature, and those terms will apply in addition to these Terms.

Suspicious Activity and Termination

Insert Affiliate reserves the right to terminate user access to the services without warning or explanation in cases where suspicious activity is detected, including but not limited to unauthorised access, fraudulent behaviour, or any actions that pose a threat to the integrity or security of the platform. Insert Affiliate may also terminate user access for any other reason deemed necessary to protect the interests of Insert Affiliate Ltd, the platform, or its users.

Indemnification

Users agree to indemnify and hold Insert Affiliate harmless from any claims, damages, losses, or liabilities, including legal fees, arising from their use of the services, violation of the Terms of Service, or infringement of any third-party rights. This indemnification includes but is not limited to claims related to user-generated content, unauthorised access to user accounts, or any other actions or omissions by the user that result in harm to Insert Affiliate or its users.

Dispute Resolution

Any disputes arising from or relating to the Terms of Service or the use of the services shall be resolved through binding arbitration administered by the International Chamber of Commerce (ICC) in accordance with its Arbitration Rules. The arbitration shall take place in Jersey, Channel Islands, and the language of the arbitration shall be English. The decision of the arbitrator shall be final and binding on both parties.

Update Clause

Insert Affiliate reserves the right to update or modify the Terms of Service at any time without prior notice. Users will be notified of any changes to the Terms via email or by posting a notice on the website. Continued use of the services after any such modifications constitutes acceptance of the updated Terms. Users are encouraged to review the Terms periodically for changes.

Governing Law

The Terms of Service and any disputes arising from or relating to them shall be governed by and construed in accordance with the laws of Jersey, Channel Islands. Any legal action or proceedings arising out of or relating to the Terms shall be brought exclusively in the courts of Jersey, Channel Islands.

Data Processing and App Store Approval

Insert Affiliate acts as a data processor, not a data controller, in relation to attribution data collected through our services. We do not guarantee approval from Apple's App Store or any other app marketplace. The customer is solely responsible for compliance with Apple's App Store Review Guidelines and App Tracking Transparency (ATT) framework, as well as all other applicable platform policies and regulations.

Refund / Dispute Policy

This includes but is not limited to any remaining months in an annual subscription. Transaction Currency

All transactions conducted through Insert Affiliate are processed in GBP (Great British Pounds). You are responsible for any fees associated with currency conversion or foreign transactions imposed by your payment provider.

Insert Affiliate uses Stripe for processing payment card transactions, which ensures the secure transmission of your payment card details over HTTPS. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. These Terms bind and benefit the parties and their permitted successors and assigns.

Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Entire Agreement. These Terms, together with any documents expressly referred to in them, constitute the entire agreement between you and Insert Affiliate Ltd regarding the Services and supersede all prior or contemporaneous understandings, communications, or agreements, whether written or oral. No statement or representation made outside these Terms may be relied upon.

Waiver. Our failure to enforce any provision of these Terms, or any delay in doing so, will not be a waiver of that provision or of our right to enforce it later. Any waiver must be made in writing to be effective.

No Third-Party Beneficiaries. These Terms are for the benefit of you and Insert Affiliate Ltd only. Except as expressly stated, no other person has any right to enforce any of these Terms, whether under any contracts (rights of third parties) legislation or otherwise.

Survival. Any provisions that by their nature should survive termination or expiry of these Terms will continue to apply, including the sections on Licence and Intellectual Property, Competitive Use Restrictions, Use of Data, APIs and Outputs, Liability, Indemnification, User Confidentiality, Dispute Resolution, Governing Law, and this General section.
